Terms and conditions
General terms and conditions
These are the general terms that apply to my paid tuition. “Part 1” refers to the details set out in your individual contract.
- Parties. In these terms and conditions, the words ‘Tutor’, ‘Client’ and ‘Student(s)’ refer to the individuals specified in Part 1 and, where applicable, any other individual with delegated authority working for and making decisions on their behalf.
- Services Offered. The Tutor agrees to provide tuition to the Student(s) specified by the Client, either in accordance with the details set out in Part 1 or as otherwise agreed subsequently between the Tutor and Client (provided in writing, including by text message, email, via in-app messaging or any other means).
- Fees. The Client agrees to pay the Tutor at the hourly rate agreed between the Tutor and Client.
- Payment Terms. The Client agrees to pay the Tutor at least 24 hours prior to the tutorial.
- Disbursements and Expenses. The Client agrees to pay disbursements and other expenses incurred by the Tutor on the Client’s behalf, as long as they have been agreed in advance of being incurred.
- Cancellation by Client. The Tutor’s cancellation terms are that lessons are chargeable to the Client if the Client cancels with less than 24 hours notice prior to the start of the lesson (or fails to show up at all). The Tutor may waive or reduce the cancellation fee, at their sole discretion, where there are genuinely extenuating circumstances.
- Cancellation by Tutor. If the Tutor has to cancel a lesson, the lesson will either be rescheduled at a mutually convenient time or, if rescheduling is not possible, no fee will be charged for that lesson.
- Technical Failure (online tuition). For online tuition, where the tutorial cannot take place or is ended prematurely due to technical failure, if the technical issue is due to the failure of the Client’s device or internet connection, this shall be treated as a cancellation by the Client and the lesson shall be chargeable. Where the technical issue is due to the failure of the Tutor’s device or internet connection, this shall be treated as a cancellation by the Tutor and shall not be chargeable.
- Punctuality. Lessons will begin and end at the scheduled times. If the Student arrives late, the lesson will still end at the originally scheduled time and the full fee will be charged. If the Tutor is late, the lesson time will be extended where convenient for the Student and Client, or otherwise the lesson will be rescheduled, or cancelled with no charge.
- Attendance at lessons. Only the Student(s) agreed in advance may attend the lesson. No additional person may attend or participate without the Tutor’s prior agreement.
- Communication Outside Lessons. Reasonable support may be provided outside of scheduled lessons at the Tutor’s discretion. The Tutor is not obligated to respond immediately and will typically respond during normal working hours.
- Lesson content changes. Any request to change the planned focus or content of a lesson must be made at least 24 hours before the scheduled start time. The Tutor will use reasonable efforts to accommodate requests made within this timeframe. Requests made with less than 24 hours’ notice may not be accommodated, and the Tutor may proceed with the lesson as originally planned.
- Progress and Outcomes. The Tutor provides educational support and guidance but does not guarantee any specific academic outcomes, including but not limited to examination results, grades, university offers or performance improvements. The Student’s progress depends on a range of factors beyond the Tutor’s control, including the Student’s own effort, engagement, and external assessment conditions.
- Continuation of Lessons. Tuition is arranged on an ongoing basis but is not guaranteed indefinitely. Either party may discontinue the booking of lessons at any time, subject to reasonable notice where practicable. Lessons already booked remain subject to the cancellation provisions of this Agreement.
- Lesson Materials and Recording. Any materials provided by the Tutor are for the Student’s personal use only and must not be shared or distributed without written permission. Lessons may not be photographed, transcribed or recorded without prior written consent from the Tutor.
- Intellectual Property. All intellectual property rights in any lesson plans, worksheets, notes, presentations, questions, model answers, recordings or other materials created or supplied by the Tutor shall remain vested in the Tutor.
- Fee Changes. The Tutor reserves the right to review and adjust fees. Any changes will be communicated in advance and will apply to future lessons only.
- Positive Learning Environment. The Tutor aims to maintain a respectful and professional learning environment. If the conduct of the Student or any other person present makes it difficult or inappropriate for the lesson to continue, the Tutor may pause or end the lesson where reasonably necessary. In more serious or repeated cases, the Tutor may also decide not to provide further tuition.
- Safeguarding and Professionalism. The Tutor acknowledges and agrees that they have, or will have prior to commencing tuition, an Enhanced DBS check dated within the last 12 (twelve) months and that they are happy to show the Client a copy on request. The Tutor further agrees either to procure a new Enhanced DBS check or equivalent every 12 (twelve) months or to register for the DBS Update Service (or equivalent) and to maintain high standards of professionalism, complying with the Code of Practice published by The Tutors’ Association, as amended.
- Dispute Resolution. In the event of a dispute arising, the parties agree to take all necessary reasonable measures and act in good faith to resolve the dispute. Should this not be possible, both sides agree to consider Alternative Dispute Resolution (ADR).
- Legal jurisdiction. This Agreement and any dispute or claim arising from it shall be governed by the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
